2. Subject of the Contract — Services Offered

The seller offers the following services (the “services”):

Single training session

500 CZK

An individual 60-minute training session at Element Gyms Olomouc. Focused on movement diagnostics and technique correction.

Package of 10 sessions

4,500 CZK

10 individual training sessions focused on long-term progress. The package is valid for 6 months from purchase.

Online Coaching

2,000 CZK/month

A tailor-made training and nutrition plan, weekly feedback and ongoing communication. Monthly subscription.

3. Formation of the Contract

The buyer expresses interest in a service via the inquiry form on the website or by directly contacting the seller by email or phone. The seller contacts the buyer within 48 hours and agrees on the specific form of cooperation, the date and the method of payment.

The contract is concluded when the order is confirmed by both parties (by email, message or phone). The buyer thereby confirms that they have read these terms of service and agree with their contents.

4. Prices and Payment

The prices listed on the website are indicative; the final price is confirmed when cooperation is agreed. The method of payment is agreed individually — typically in cash on site or by bank transfer before the service begins (or before the first session of a package).

For Online Coaching, payment is made monthly before the start of each subsequent billing period, using the method agreed upon conclusion of the contract.

5. Provision of Services

Single session and Package of 10 sessions:

  • After purchase, the seller contacts the buyer within 48 hours to arrange a date.
  • Sessions take place at Element Gyms Olomouc or another agreed location.
  • Package sessions may be used for 6 months from purchase. After this period, unused sessions expire without a right to a refund.
  • Cancelling or rescheduling a session is possible at least 24 hours in advance. Later cancellation counts as a used session.

Online Coaching:

  • An individual training and nutrition plan is delivered by email within 48 hours of the first payment.
  • Communication takes place by email or through an agreed platform.
  • The plan is updated based on weekly reports sent by the buyer.

6. Withdrawal from the Contract

A consumer (a natural person not acting in the course of business) has the right to withdraw from a contract concluded remotely, without giving a reason, within 14 days of concluding the contract under Section 1829 of Act No. 89/2012 Coll. (Civil Code).

Important notice: If the buyer expressly agrees to the service beginning before the withdrawal period expires, the right of withdrawal ceases at the moment of performance or the start of the service (Section 1837(a) of the Civil Code). This applies in particular to a single session and the first session of a package — by attending them, the right of withdrawal ceases.

For the Online Coaching subscription, the subscription can be cancelled at any time by sending an email to ondrej.luczka@email.cz. The cancellation takes effect at the end of the current billing period.

Send a withdrawal from the contract by email with the subject “Withdrawal from the contract — [your name] — [payment date]”. Funds will be refunded within 14 days of receiving the withdrawal.

7. Complaints (Liability for Defects)

The seller is responsible for ensuring that the services are provided properly and to the agreed extent.

A complaint must be filed without undue delay after a defect is discovered, by email to ondrej.luczka@email.cz. The complaint must include a description of the defect and the requested method of resolution.

The seller will confirm receipt of the complaint within 3 business days and resolve it within 30 days of it being filed. Methods of resolution: repeating the service, a discount, or a refund of a proportional part of the price.

8. Out-of-Court Dispute Resolution

The Czech Trade Inspection Authority (COI), Stepanska 567/15, 120 00 Prague 2 — www.coi.cz, is competent for the out-of-court resolution of consumer disputes. EU online dispute resolution platform: ec.europa.eu/consumers/odr.

9. Personal Data Protection

The processing of the buyer's personal data is governed by the Privacy Policy, which forms an integral part of these terms of service.

10. Final Provisions

These terms of service are governed by the law of the Czech Republic, in particular Act No. 89/2012 Coll. (Civil Code) and Act No. 634/1992 Coll. (Consumer Protection Act).

The seller reserves the right to unilaterally amend these terms. The current version is always available on this page. Contracts already concluded are governed by the version in effect at the time the contract was concluded.
